{"id":2516,"date":"2025-05-01T14:14:26","date_gmt":"2025-05-01T20:14:26","guid":{"rendered":"https:\/\/oursask.info\/rm39\/?page_id=2516"},"modified":"2025-10-14T15:17:48","modified_gmt":"2025-10-14T21:17:48","slug":"development-permits-building-permits","status":"publish","type":"page","link":"https:\/\/oursask.info\/rm39\/administration\/governance\/development-permits-building-permits\/","title":{"rendered":"Development &amp; Building"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">\ud83c\udfd7\ufe0f Development &amp; Building Permits<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Rural Municipality of The Gap No. 39<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\ud83d\udcd8 Planning Framework<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The RM of The Gap No. 39 has adopted the following bylaws to guide community development:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Official Community Plan \u2013 Bylaw No. 7\/2020<\/strong>: Identifies the unique needs of our community and supports long-term sustainability.<\/li>\n\n\n\n<li><strong>Zoning Bylaw \u2013 Bylaw No. 8\/2020<\/strong>: Provides development standards to protect the health, safety, and general welfare of residents.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Zoning Bylaw outlines the process for submitting a development permit application and the criteria used to evaluate proposals. There are two types of development permits:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Permitted Use Development Permits<\/strong><\/li>\n\n\n\n<li><strong>Discretionary Use Development Permits<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">\ud83c\udfe1 Permitted Use Development Permits<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You must apply for a <strong>Permitted Use Development Permit<\/strong> if you are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Constructing a new residence<\/li>\n\n\n\n<li>Building an agricultural accessory structure larger than <strong>500 ft\u00b2<\/strong><\/li>\n\n\n\n<li>Developing a new <strong>bin yard<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">You do <strong>not<\/strong> need a permit for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Agricultural accessory structures <strong>500 ft\u00b2 or smaller<\/strong> (e.g., grain bins, mobile storage containers)<\/li>\n\n\n\n<li>Internal building alterations<\/li>\n\n\n\n<li>Landscaping that does not affect drainage<\/li>\n\n\n\n<li>Temporary use structures<\/li>\n\n\n\n<li>Installation of a well or septic tank<\/li>\n\n\n\n<li>Installation of signage<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Note: This list is not exhaustive. Please contact the municipal office to confirm whether a permit is required for your specific project.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\ud83c\udfe2 Discretionary Use Development Permits<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You must apply for a <strong>Discretionary Use Development Permit<\/strong> for developments such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Commercial greenhouses<\/li>\n\n\n\n<li>Bed and breakfast homes<\/li>\n\n\n\n<li>Animal kennels<\/li>\n\n\n\n<li>Accessory agricultural residences (e.g., boarding houses)<\/li>\n\n\n\n<li>New or expanded intensive livestock operations<\/li>\n\n\n\n<li>Solar energy systems<\/li>\n\n\n\n<li>Gravel pit development<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Note: This list is not exhaustive. Please contact the municipal office to confirm whether a permit is required for your specific project.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\ud83d\udcb0 Development Permit Fees<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Permit Type                Fee                       Reviewed By<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Permitted Use             $100.00               Development Officer<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Discretionary Use       $200.00               Municipal Council<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\ud83d\udcdd How to Apply for a Development Permit<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Contact the <strong>Development Officer (Administrator)<\/strong> to discuss the application process. Requirements may vary depending on the nature of your proposed development.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\ud83e\uddf1 Building Permits<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The RM of The Gap No. 39 has adopted a <strong>Building Bylaw \u2013 Bylaw No. 1\/2023<\/strong>, which enforces:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Construction Codes Act<\/li>\n\n\n\n<li>The Building Code Regulations<\/li>\n\n\n\n<li>The Energy Code Regulations<\/li>\n\n\n\n<li>National Building Code of Canada<\/li>\n\n\n\n<li>National Energy Code of Canada for Buildings<\/li>\n\n\n\n<li>Ministerial interpretations and appeal board orders<\/li>\n\n\n\n<li>Building Official orders<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">\ud83c\udfd7\ufe0f When Is a Building Permit Required?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A building permit is required for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Any building larger than <strong>10 m\u00b2 (107.6 ft\u00b2)<\/strong>, except for farm use buildings*<\/li>\n\n\n\n<li>Retaining walls over <strong>600 mm (2 ft)<\/strong> in height<\/li>\n\n\n\n<li>Decks more than <strong>600 mm (2 ft)<\/strong> above ground level<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Note: Farm use buildings that include living quarters <strong>do require<\/strong> a building permit.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\ud83d\udcb0 Building Permit Fees<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Building Type                                     Fee <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One-family dwelling or accessory     $100.00 <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Commercial Property                         $200.00 <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The building owner is responsible for all service fees charged by the Building Official for plan reviews and inspections.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\ud83d\udcdd How to Apply for a Building Permit<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Contact the <strong>Administrator<\/strong> to discuss the application process. Requirements vary depending on the type and scope of your project.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\ud83d\udee0\ufe0f Approved Building Officials<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The RM of The Gap No. 39 contracts two licensed Building Official groups:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Professional Building Inspections, Inc. (PBI)<\/strong><\/li>\n\n\n\n<li><strong>Municode Services Ltd.<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">You may choose either group to conduct your plan review and inspections.
