Development Permits

The Rural Municipality of The Gap No. 39 has adopted an Official Community Plan – Bylaw No. 7/2020 and a Zoning Bylaw – Bylaw No. 8/2020. The Official Community Plan identifies the unique needs of a community in relation to its future sustainability. The Zoning Bylaw provides guidance for development to ensure the health, safety and general welfare of the residents of the community.

The Zoning Bylaw outlines the process and procedure for submitting a development permit application to obtain approval for a proposed development. The Zoning Bylaw also outlines the criteria that are used for evaluating a development permit application. There are two types of development permits: permitted use development permits and discretionary use development permits.

  1. When do I need to apply for a permitted use development permit?

A development permit is required when constructing a new residence, when constructing an agricultural accessory building larger than 500 ft2, or when developing a new bin yard*.

A development permit is not required for: agricultural accessory use structures (accessory buildings of 500 ft2 or smaller, grain bins, mobile storage containers), internal building alterations, landscaping that doesn’t impact drainage, temporary use structures, installation of a well or septic tank, or installation of signage.

  • When do I need to apply for a discretionary use development permit?

A discretionary use development permit is required for commercial greenhouses, bed and breakfast homes, animal kennels, accessary agricultural residences (boarding house), new or expanded intensive livestock operations, solar energy systems, and gravel pit development, just to name a few*.

  • What are the fees associated with development Permit Applications?

The Development Permit application fee for Permitted Uses is $100.00. Development applications for Permitted Uses are reviewed by the Development Officer (Administrator).

The Discretionary Use Permit application Fee is $200.00. Development applications for Discretionary Uses are reviewed by Council.

Building Permits

The Rural Municipality of The Gap No. 39 has adopted a Building Bylaw – Bylaw No. 1/2023. The purpose of this building bylaw is to provide for the administration and enforcement of the The Construction Codes Act, The Building Code Regulations, The Energy Code Regulations, the National Building Code of Canada, the National Energy Code of Canada for Buildings, ministerial interpretations and Saskatchewan Construction Standards Appeal Board orders, and building official orders within the local authority.

  1. When do I need a building permit?

A building permit is required for all buildings greater than 10 m2 (107.6 ft2) in building area, with the exception of farm use buildings*. Building permits are also required for retaining walls greater than 600 mm (2 ft) in height and decks greater than 600 mm (2 ft) off ground level.

*Farm use buildings with living quarters require a building permit. 

  • What are the fees associated with building permit applications?

A building permit application fee is $100.00 for a one family residential dwelling or accessory building and $200.00 for a commercial property.

The building owner is required to pay the actual cost of all service fees charged by the Building Official contracted by the local authority to conduct all building plan reviews and inspections.

  • Who is the group of Building Officials contracted by the Rural Municipality of The Gap No. 39?

The Rural Municipality of The Gap No. 39 has contracted both Professional Building Inspections, Inc. (PBI) and Municode Services Ltd. as their groups of licenced Building Officials. The building owner may select either group of Building Officials to review and inspect their construction project. Once a group of Building Officials has been selected by the owner, the owner must complete their project with the selected group of building officials.
